A controversial planning application which was quashed and sent back for re-determination by Babergh planers is due to be decided by committee next Wednesday.

The application for 64 homes to be built at a development called Weavers Green on land east of Sand Hill, was given outline permission last year but following a judicial review launched by Boxford Parish Council, a High Court ruled in March, that the planning committee had made a "material error in law" in the approval conditions, and returned the application to be redetermined.

Following a case review by officers, the plans have again received a recommendation for approval as the benefits are considered to outweigh in harm, as determined in planning law and Babergh policies.

Boxford Parish Council has written to Babergh formally requesting the decision date to be deferred, so more time can be given to review the key issues.

Chairman Julian Fincham-Jacques has been quoted as saying: "This is a highly contentious application and the failure to give the community adequate time to participate and respond to the latest reports, without new consultation having taken place, is manifestly unfair and contrary to the rules of natural justice.

"The highways issues, public building and failure to adequately meet various planning policies are, in particular, a matter of great concern, and the parish council is not satisfied by the response given by the highways officer or the treatment of the issues to date.

"We feel more time should be given to discuss matters with the relevant experts, and that the planning committee would be receptive to further submissions on these points.

"We are also conscious that members of the current committee have also not had or been given the opportunity to conduct a site meeting to fully understand the issues. Only the committee who refused the original application had the opportunity."
